Terms of Use

These Terms of Use ("Terms") govern your use of the HoofScore mobile application and related services (the "Service"), provided by CHEVAL TECHNOLOGIES PTY LTD ("HoofScore", "we", "us", or "our").

By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Service.

1. Eligibility and Accounts

• You must be at least 18 years old, or the age of majority in your place of residence, to use the Service.
• You must provide accurate and complete information and keep your login credentials secure.
• You are responsible for activities carried out through your account.
• You may sign in using email, Google, or Facebook. Third-party sign-in services are subject to their own terms and policies.

2. The Service

HoofScore is an AI-powered horse hoof health platform. The Service allows you to:

• Add and manage horse and hoof information
• Capture or upload hoof photos (still images only)
• Receive AI-generated hoof analysis and health scores
• Track assessment history
• Generate reports and recommendations
• Request 3D models
• Participate in community features

We may add, modify, suspend, or remove features of the Service at any time.

3. Not Veterinary Advice

HoofScore's analyses, health scores, recommendations, articles, reports, and community content are provided for general informational and educational purposes only.

⚠️ They are not a substitute for professional veterinary, farrier, trimmer, or other qualified animal-health advice, diagnosis, or treatment.

AI-generated results may be inaccurate, incomplete, or unsuitable for a particular horse or situation. Consult a qualified professional before making decisions about your horse's health, hoof care, treatment, or welfare. You use any output of the Service at your own risk.

4. Subscriptions and Payments

4.1 Paid Plans

Some features require a paid HoofScore Pro subscription, offered on a monthly or yearly basis. Prices and terms are displayed in the app before purchase.

4.2 Free Trials

Where a free trial is offered, you will not be charged until the trial ends. Unless you cancel at least 24 hours before the trial ends, your subscription may automatically begin. Trial availability and eligibility are determined by Google Play or the Apple App Store.

4.3 Auto-Renewal

Subscriptions automatically renew at the then-current price unless you cancel at least 24 hours before the end of the current billing period.

4.4 Cancellation

You may cancel at any time through:

• Android: Google Play → Payments & subscriptions
• iOS: Settings → Apple ID → Subscriptions

Cancellation prevents future renewals; you generally keep access to paid features until the end of the current billing period.

⚠️ Uninstalling HoofScore or deleting your account does not automatically cancel your subscription.

4.5 Plan Changes

Where supported, switching between monthly and yearly plans may take effect at the end of your current billing period unless otherwise stated at the time of the change.

4.6 Platform and Account Binding

Subscriptions are billed and managed by the platform you purchased through. A subscription is associated with the HoofScore account used for the purchase, and a Google Play or Apple account may support a subscription for only one HoofScore account at a time, subject to platform rules.

4.7 Refunds

Refunds are handled by Google Play or Apple under their refund policies. If a purchase is refunded, revoked, or invalidated, access to HoofScore Pro features may be terminated.

4.8 Price Changes

We may change subscription prices from time to time. Where required, you will receive advance notice, and the new price will generally apply from your next renewal.

5. Your Content

You retain ownership of the content you submit, including horse information, photos, posts, and comments ("Your Content").

By submitting Your Content, you grant HoofScore a worldwide, non-exclusive, royalty-free licence to host, store, process, reproduce, and display it as reasonably necessary to provide, operate, maintain, improve, and secure the Service, including AI processing for hoof analysis and displaying community content to other users.

This licence ends when you delete the content or your account, except where content has already been shared with other users or retention is required by law. You confirm you have the rights needed to submit Your Content and that it does not infringe anyone's rights.

6. Community Rules

You must not:

• Post unlawful, harmful, abusive, harassing, hateful, misleading, sexually explicit, or otherwise inappropriate content
• Post or promote content involving animal cruelty or abuse
• Infringe intellectual property, privacy, or other rights of others
• Impersonate another person or organization
• Post spam, unauthorized advertising, malware, or malicious code
• Scrape, copy, reverse-engineer, disrupt, or attempt unauthorized access to the Service
• Use the Service for any unlawful or fraudulent purpose

We may remove content or suspend or terminate accounts that violate these Terms.

7. Intellectual Property

The Service, including its software, design, interface, AI models, algorithms, articles, reports, 3D models, trademarks, and logos, is owned by or licensed to CHEVAL TECHNOLOGIES PTY LTD and protected by intellectual property laws.

We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service for personal, non-commercial purposes. You may not copy, modify, distribute, sell, sublicense, reverse-engineer, or otherwise exploit the Service except as permitted by law or with our prior written permission.

8. Third-Party Services

The Service may rely on third-party services, including Google, Apple, Meta, cloud hosting, analytics, payment, and AI service providers. We are not responsible for their availability, functionality, or practices, and your use of them is subject to their own terms and policies.

9. Termination

You may stop using the Service and delete your account at any time through Profile → Settings → Delete Account.

We may suspend or terminate access if you violate these Terms, misuse the Service, engage in unlawful activity, or where reasonably necessary to protect the Service or others. Provisions that by their nature should survive termination (intellectual property, disclaimers, liability, indemnification, governing law) remain in effect.

10. Disclaimers

The Service is provided "as is" and "as available", to the fullest extent permitted by law. We make no warranties regarding its accuracy, reliability, availability, suitability, or completeness. We do not guarantee that:

• The Service will always be available or uninterrupted
• The Service will be error-free or secure
• AI-generated analysis, scores, or recommendations will always be accurate, complete, or appropriate
• The Service will meet your particular requirements

11. Limitation of Liability

To the fullest extent permitted by law, CHEVAL TECHNOLOGIES PTY LTD will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including losses relating to data, profits, business opportunities, or reliance on AI-generated outputs.

Our total liability for any claim is limited to the amount you paid us for the Service in the 12 months before the event giving rise to the claim.

Nothing in these Terms excludes or limits any liability or consumer right that cannot legally be excluded or limited, including under the Australian Consumer Law.

12. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless CHEVAL TECHNOLOGIES PTY LTD, its officers, employees, contractors, and service providers from claims, losses, and costs arising from:

• Your violation of these Terms
• Your misuse of the Service
• Your Content
• Your violation of the rights of another person or entity
• Your unlawful use of the Service

13. Governing Law

These Terms are governed by the laws of Queensland, Australia. Subject to any mandatory consumer protections that apply to you, disputes will be subject to the jurisdiction of the courts of Queensland, Australia.

14. Changes to These Terms

We may update these Terms. Changes will be posted with an updated Effective Date and, where required, notified through the app. Continued use after changes take effect means you accept the revised Terms, to the extent permitted by law.
